Important Notice

  1. 1. This form of Licence Agreement is for use in those cases where the Premises are part of a house or flat which the owner occupies as his/her only or principal home and at the date of this Agreement there is an ordinary means of access (such as a door) between the Owner’s part and the Lodger’s part of the house or flat whether or not that access is available to the Lodger. Neither an Assured Tenancy nor Short Assured Tenancy is created.
  2. 2. This form of Licence Agreement does not require either party to give any form of notice to the other at the end of the fixed Period, but it is nevertheless prudent to give written notice if either party wishes to end this Agreement early, as referred to in the definition of the Period near the middle of this Agreement.

Terms and conditions

  1. 1. The Owner will:
    1. 1.1 provide for the use of the Lodger the Premises and shred us of the common parts of the Property (including such bathroom, toilet, kitchen and sitting room facilities as may be at the Property) as may be reasonably required by the Lodger and as shall be permitted by the Owner,
    2. 1.2 provide for the use of the Lodger all such household and table linen, china, glass, cutlery and table utensils as may be reasonably required but shall not be bound to provide any domestic service or attendance in the Premises or in the property.

  3. 12. All references to the singular shall include the plural and vice versa and any obligations or liabilities of more than one person shall be join and several and an obligation on the part of a party shall include an obligation not to allow or permit the breach of that obligation.
  4. 13. This Agreement will be governed by and construed in accordance with the Law of Scotland and the parties submit to the jurisdiction of the Scottish Courts.
